1. Do I need to rewrite my will when buying a new apartment or car?
No, not if your will is professionally drafted. We'll write the wording. «all-encompassing clause», which covers all current and future assets within the UAE. Re-registration is only required if there is a change in the heirs or executor of the will.
2. Is it possible to draw up a will remotely if I am currently in Russia?
Yes. Through the system. ADJD (Abu Dhabi Judicial Department) Registration is completely online via video conference. All you need is a passport, a stable internet connection, and the draft document we've prepared. Personal presence in the UAE is not required.
3. What happens to my bank accounts if there is no will?
According to UAE practice, personal accounts (including joint accounts of spouses) are frozen by the bank immediately upon notification of the owner's death. Unfreezing the account through a local court without a will can take from six to 18 months, during which time the family will not be able to access the funds. A will reduces this period to a few weeks.
4. Will the UAE authorities recognize my Russian will?
In theory, yes, based on the law on the civil status of non-Muslims. In practice, it's a bureaucratic maze. The document must be translated, legalized by the Russian Ministry of Foreign Affairs, the UAE Embassy, and the UAE Ministry of Justice, and then a court order must be obtained. This costs three to four times more than drafting a local will from scratch.
5. Who is the «Executor» and does it have to be a lawyer?
An executor is the person who will administer your estate to the court and the banks after your death. This could be a spouse, an adult child, or a trusted friend. We recommend appointing one primary executor and one backup executor (in case the primary executor is unable to serve).
6. Will a will protect my business in the Free Zone?
Yes. A will in the DIFC or ADJD allows for the seamless transfer of company shares to heirs. Without one, the transfer of company shares may be frozen, effectively paralyzing the business and employee benefits.
